JUDICIAL & ATTORNEY OVERSIGHT REFORMS

WHEREAS:

       A Democratic-Republic Necessitates: government that is truly for, of, & by the people;

       We The People cannot maintain our freedoms and control over our government, and no fraternity can exist between us and Our public servants without Our direct involvement and oversight;

       Our judiciary and those entrusted with authority to represent and serve us in the legal professions (particularly those in public service) have abdicated their duty, committed malfeasance in office, and/or are openly committing criminal acts under Our laws and constitutions;

       The Judicial Tenure and Attorney Grievance Commissions: 1) fail to hold fair and impartial preliminary investigations; and, 2) there is an institutional reluctance to investigate complaints against those who occupy positions of political power and influence.

THEREFORE: 

WE THE PEOPLE recognise the necessity of the following reforms to our Judicial Tenure and Attorney Grievance oversight procedures as follows:

       1.   Provide that citizens form the majority voice on the panels that decide which attorney misconduct and judicial malfeasance cases will be investigated, prosecuted, and what outcomes enforced. 

        2.   Provide disclosure; via prominently displayed signs in every courthouse with a State Bar leaflet describing the grievance process for judicial misconduct and malfeasance. And with substantive explanations for dismissals and unfavorable rulings so that We understand the basis for decisions and have the grounds to challenge them.

      3.   Require disclosure of the lawyer discipline process through attorney-client notifications of how to review a lawyer’s disciplinary record; Our right to file an ethics complaint; and, a clear description of how to find and acquire the necessary “Request for Investigations” forms. 

      4.   Require thorough and complete discloses of a lawyer or judge’s disciplinary history so that We can make informed decisions about whether to hire an attorney or vote for a judge. 

      5.   Provide a user-friendly easy to find web site with: 1) straight forward information about the discipline process, 2) pdf fill-able “Request for Investigation” forms that can be submitted online; and, 3) broadly posted schedules of upcoming hearings.

      6.   Permanently disbar lawyers and judges who commit abusive practices against clients, commit criminal acts; or, that are otherwise guilty of malfeasance in office. 

      7.   Abolish gag rules that prevent people from speaking publicly about the complaints they’ve filed. And provide Plaintiff / witness immunity from civil liability for information or testimony provided to the agencies during a disciplinary investigation.
